“My career has always involved standing up to the government when it has engaged in outrageous misconduct, at least since I left the U.S. Attorney’s Office,” May points out.
“In representing General Manuel Antonio Noriega at trial and on appeal, I uncovered significant government misconduct. While I was unsuccessful in getting that conviction overturned, I did demonstrate the government’s efforts to win no matter the cost. Where the national defense was not at stake, I have been successful in getting cases thrown out.”
His book, “Who Says You Can’t: Strategies and Tactics for Becoming a More Creative Criminal Defense Lawyer,” demonstrates both the theory and practice of finding creative ways to go about solving seemingly intractable problems in the defense of individuals and companies accused of a crime.
He explains that if you are under investigation by the federal government or have been charged with a federal offense, it’s important to find a lawyer who can answer seven fundamental questions, including: “Have you ever convinced a prosecutor not to charge your client, or abandon a prosecution after charges have been filed?” and “How many times have you tried a case as a defense attorney?”
“The best lawyers won’t hesitate to answer these questions because they have actually won cases,” May adds.
He started his career as a public defender, representing indigents in criminal appeals for the Public Defender’s office in West Palm Beach. Within a year of graduating, May argued his first case before the Supreme Court of Florida and after that, was moved to the Capital Appeals section.
In 1981, May was hired to run the appellate division of the United States Attorney’s Office in the Southern District of Florida, while its chief was on maternity leave.
May has tried cases around the country, successfully representing heads of companies. He has assisted some of the top lawyers in the nation in defending their clients.
