Appellate Law Attorney
Erin Pogue Newell is a natural-born appellate attorney. It’s the way her brain works — analyzing and organizing records, testimony and evidence; spotting issues; identifying legal standards; applying the law to the facts; and persuasively communicating with the court.
Newell attributes her success as an appellate attorney to her roots as a teacher and says her purpose on appeal is similar to what it was as a high school English teacher: “educate, persuade, prevail.”
She continues to perfect her craft as an adjunct professor at St. Thomas University Benjamin L. Crump School of Law, where she teaches legal research and writing and appellate advocacy.
Newell also recently founded her solo practice, Open Book Appeals, where she focuses on all facets of civil appellate litigation, particularly family law, business law, real estate, property and personal injury appeal, and provides consultation and research and writing services to trial attorneys and their clients.
“I enjoy being part of the process of interpreting and clarifying the law,” she says. “The best part of appellate practice is impacting how the law is applied.”
Newell’s expert-level research and writing skills benefit her clients.
Newell says, “Many attorneys are nervous about communicating with the appellate court. But I excel in persuasive writing and enjoy finding new ways to use the latest technologies in legal research. I presented my first oral argument in the Third District Court of Appeal the day I was sworn into The Florida Bar. It’s where my aptitude is, and I enjoy it.”
Newell has come a long way since her first oral argument. She has presented appeals in all six of Florida’s District Courts of Appeal, the Florida Supreme Court and United States Court of Appeals for the Eleventh Circuit.
Most recently, she won a nonfinal appeal regarding the applicability of Florida’s long-arm jurisdiction statute in Ningbo Daye Garden Machinery Co., Ltd. v. International Global Resources Corp., 384 So. 3d 220 (Fla. 4th DCA 2024).
