Community Association Attorney

Attorney Donna DiMaggio Berger is passionate about representing condominium and homeowners associations throughout Florida by helping them to efficiently and effectively operate their communities. Berger, a shareholder at Becker, helps volunteer board members and their managers tackle tough challenges, including rising insurance rates, costly maintenance and repair projects, governing document updates and more. She is a board certified specialist in condominium and planned development law and a Fellow of the College of Community Association Lawyers (CCAL).

“I enjoy being a problem solver. It’s great to sit with a board or a manager and come up with a solution to a problem that had been creating enormous stress for them,” she says. “Representing communities is an ‘up close and personal’ type of legal practice. Seeing familiar faces at board and membership meetings each year is a great way to connect on a different level with my clients.”

Having served on her own HOA board years ago, Berger handles the association attorney role with an understanding of the myriad emotions involved with many community disputes.

“For many people, their home is their single biggest investment and many of those homes are situated inside mandatory community associations. Helping boards operate and administer their communities in a legal, transparent and effective manner is a large part of what I do,” she says.

This year, Berger helped bring an affiliated public adjusting company to the market to assist Florida community associations navigating insurance claim recovery.

“Association Adjusting is now helping hundreds of our impacted Florida communities recover from the terrifying impact of Hurricane Ian,” she says. “It is incredibly gratifying to see an idea become a reality and then flourish.”

In her free time, Berger hosts an informative and entertaining podcast with special guests that discusses homeowner and community association issues called “Take It To The Board.” She just recorded its 40th episode.

“Having passion projects like these helps me better understand the ever-changing challenges my clients face and often gives me a fresh perspective on how to tackle those challenges,” she says.
